A 33-year-old accused of raping his now eight-year old stepdaughter over almost for years won an appeal in the Western Cape High Court yesterday for bail.
The man from the Breede River Valley, is charged with rape between 1 January 2007 and 18 December 2010.
He cannot be named to protect the child’s identity. A local magistrate denied him bail on 2 February, ruling there were no “exceptional circumstances”. However Judge Dennis Davis found yesterday the magistrate had pointed out “powerful circumstances” but had failed to take them into account. He granted bail of R500, which was all the stepfather could afford.
